Bolt Action Furniture

These Terms & Conditions apply to orders for furniture and related services supplied by Bolt Action Furniture ("Bolt Action Furniture", "we", "us" or "our").
By placing an order with Bolt Action Furniture, the customer ("you" or "the customer") agrees to these Terms & Conditions.
These Terms & Conditions should be read together with our Refunds, Returns, Consumer Guarantees & Warranty Policy.
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies that cannot legally be excluded under the Australian Consumer Law (ACL).

2. Products and Custom Furniture
Bolt Action Furniture specialises in custom-made and made-to-order furniture.
Products may be produced according to individual customer requirements, including customised:
Dimensions;
Designs;
Materials;
Timber;
Colours;
Stains;
Finishes;
Hardware;
Drawer configurations;
Electrical features;
Wireless charging systems; and
Other agreed specifications.
Because many products are made specifically for individual customers, the customer is responsible for carefully reviewing and approving the final specifications before production begins.
3. Quotes and Estimates
Quotes are based on the specifications and information available to Bolt Action Furniture at the time the quote is prepared.
A quote may change where the customer:
Changes the design;
Changes dimensions;
Changes materials or finishes;
Adds or removes features;
Changes delivery requirements;
Requests installation;
Requests additional work; or
Provides information that differs from the information on which the original quote was based.
Where reasonably practicable, any additional costs will be communicated to the customer before the additional work is undertaken.
A quote is not considered an accepted order until the order has been confirmed and the required deposit has been received.
4. Order Confirmation
An order is confirmed when:
The customer has accepted the relevant quote;
The required specifications have been agreed;
Any required design or measurements have been approved; and
The required deposit has been received.
Once an order is confirmed, Bolt Action Furniture may commence purchasing materials, ordering components and allocating production time.
5. Deposit and Payment
A 50% deposit is required to confirm an order and commence production.
The remaining 50% balance is payable before delivery, collection or release of the completed furniture, unless another arrangement has been agreed in writing.
The deposit is used to secure production time and may be used toward materials, hardware, electrical components and other items required specifically for the customer's order.
The deposit does not remove or reduce any rights the customer has under the Australian Consumer Law.
6. Design Approval
Where a custom design, drawing, plan, render or specification is provided to the customer for approval, the customer is responsible for checking the information carefully before approving production.
The customer should check, where applicable:
Overall dimensions;
Individual dimensions;
Placement of shelves and drawers;
Door and drawer configuration;
Colour;
Timber;
Finish;
Hardware;
Electrical features;
Charging features;
Installation requirements; and
Any other custom specifications.
Once the customer approves the final design or specifications, production may commence.
Any errors in customer-approved specifications that are subsequently requested to be changed may result in additional costs or delays.
This section does not limit the customer's rights where Bolt Action Furniture fails to supply the product in accordance with the agreed specifications or otherwise breaches an applicable consumer guarantee.
7. Customer Measurements
Where the customer provides measurements, the customer is responsible for ensuring that those measurements are accurate.
This includes measurements relating to:
Available space;
Wall dimensions;
Doorways;
Hallways;
Stairways;
Lifts;
Ceiling heights;
Access points;
Installation areas; and
Any other dimensions necessary for delivery or installation.
Where Bolt Action Furniture takes measurements itself, we will take reasonable care in carrying out that measurement service.
Where a customer provides incorrect measurements and the furniture is subsequently made according to those measurements, additional costs may apply if changes, alterations, remaking or additional work are requested, subject to the customer's rights under the ACL.
8. Production Lead Time
Our standard estimated production lead time is approximately 4 weeks.
The production period generally begins once:
The deposit has been received;
Final specifications have been approved;
Required measurements have been confirmed; and
Any necessary materials or components can reasonably be obtained.
The 4-week period is an estimate rather than an unconditional guarantee of completion on a particular date.
Production may take longer due to:
Material availability;
Supplier delays;
Customer-requested changes;
Unforeseen manufacturing issues;
Delays relating to specialised components;
Delivery availability;
Installation requirements; or
Circumstances outside our reasonable control.
We will communicate significant delays where reasonably practicable.
Nothing in this section limits any rights the customer may have under the ACL if a product or service is not supplied within a reasonable time or an agreed timeframe is not met.
9. Changes After Order Confirmation
Customers should request changes before production begins.
Changes requested after production has commenced may:
Increase the price;
Require additional materials;
Result in wasted materials;
Extend the production timeframe; or
Be impossible depending on the stage of production.
Where a requested change can be accommodated, Bolt Action Furniture will advise the customer of any additional cost before proceeding where reasonably practicable.
10. Cancellation by the Customer
Because custom furniture is made specifically for the customer, cancellation and change-of-mind requests may result in costs being incurred.
Where a customer requests cancellation before production begins, Bolt Action Furniture will consider the request and may refund amounts paid less any reasonable costs already incurred specifically for the order, where permitted by law.
Where production has commenced, reasonable costs already incurred may be taken into account when determining any amount refundable.
These costs may include:
Materials purchased specifically for the order;
Custom hardware;
Electrical or electronic components;
Special-order materials;
Work already completed;
Reasonable production costs; and
Other reasonable costs directly resulting from the order.
Where materials or components can reasonably be reused, Bolt Action Furniture will take this into account.
Nothing in this section excludes or limits rights that cannot legally be excluded under the ACL.
11. Change of Mind
A customer does not generally have an automatic right to return custom-made furniture solely because they have changed their mind.
However, this does not affect any rights the customer may have where the product:
Has a major failure;
Has another failure covered by a consumer guarantee;
Does not match its description;
Does not match agreed specifications;
Is not of acceptable quality;
Is not fit for a disclosed purpose; or
Otherwise fails to comply with the ACL.
12. Delivery
Bolt Action Furniture primarily delivers throughout Melbourne and surrounding areas.
Australia-wide delivery may be available for selected products.
Delivery of other products to locations outside Melbourne may also be arranged depending on:
Product size;
Product weight;
Delivery location;
Freight availability;
Transport requirements;
Access requirements; and
Availability of suitable delivery services.
Delivery costs will be communicated and agreed with the customer before delivery where reasonably practicable.
13. Delivery Access
The customer is responsible for providing accurate information about the delivery location and any relevant access restrictions.
Customers should consider:
Doorway widths;
Hallway widths;
Stairways;
Lift dimensions;
Parking access;
Building access;
Narrow passages;
Ceiling heights; and
Other restrictions that may affect delivery.
Where a delivery cannot reasonably be completed because of information or access conditions provided by the customer, additional costs may apply where permitted by law.
Customers should contact Bolt Action Furniture before delivery if they are unsure whether the furniture will fit through a particular access point.
14. Installation
Most Bolt Action Furniture products are designed to be installed by the customer.
Installation by Bolt Action Furniture may be arranged for an additional fee.
Installation pricing may vary depending on:
Location;
Product;
Size;
Complexity;
Wall or floor construction;
Access;
Required equipment; and
Other site conditions.
Where Bolt Action Furniture provides installation, the installation service will be performed with due care and skill.
Where installation is performed by the customer, the customer is responsible for following the supplied instructions.
Incorrect installation, misuse or modification may affect the voluntary warranty, but does not remove any statutory rights relating to defects in the underlying product.
15. Electrical and Electronic Components
Some Bolt Action Furniture products incorporate electrical or electronic components, including:
LED lighting;
Transformers;
Power supplies;
Wireless phone charging systems; and
Other integrated electrical components.
These components form part of the product supplied by Bolt Action Furniture and are subject to applicable consumer guarantees and product-safety requirements.
Customers must use electrical components in accordance with supplied instructions.
Customers must not modify, bypass, dismantle or alter electrical components or wiring.
Where electrical installation work requires a licensed electrician or registered electrical contractor, that work must be carried out by an appropriately licensed and/or registered person.
In Victoria, applicable electrical installation work must be carried out in accordance with Victorian electrical safety requirements. EEnergy Safe Victoria+1
If an electrical component appears to be faulty, customers should contact Bolt Action Furniture before attempting to repair or modify the component.
16. Wireless Phone Charging
Where wireless phone charging is incorporated into furniture, the charging system is supplied as part of the product.
Charging performance may vary depending on:
Phone model;
Device compatibility;
Phone case;
Device positioning;
Device settings; and
Other factors outside Bolt Action Furniture's control.
The charging system should only be used with compatible devices and according to supplied instructions.
A device being incompatible with the charging system does not necessarily constitute a product defect.
Where the charging system itself is defective, the customer may have rights under the ACL and/or our voluntary warranty.
17. Drawer Runners and Hardware
Products may contain drawer runners, hinges, slides, handles or other mechanical hardware.
These components are intended to be used within their reasonable design and load limits.
Damage caused by:
Excessive loading;
Impact;
Misuse;
Forced operation;
Incorrect installation;
Unauthorised modification; or
Accidental damage
may not be covered by our voluntary warranty.
This does not affect any applicable ACL rights.
18. Natural Timber and Material Variation
Timber is a natural material.
Variations may occur in:
Grain;
Colour;
Texture;
Knots;
Figure;
Natural markings; and
Appearance over time.
Finished furniture may therefore differ slightly from photographs, digital renders, samples or previously produced pieces.
These natural characteristics are not ordinarily defects.
However, natural variation does not excuse a genuine manufacturing defect or failure to comply with an applicable consumer guarantee.
19. Product Care
Customers are responsible for following any care and maintenance instructions supplied with the furniture.
Depending on the material and finish, this may include avoiding:
Excessive moisture;
Harsh chemicals;
Excessive heat;
Direct prolonged exposure to sunlight;
Excessive weight;
Improper cleaning products; and
Other conditions that may damage the furniture.
Failure to follow reasonable care instructions may affect the voluntary warranty where the damage is caused by that failure.
It does not exclude rights available under the ACL.
20. Safety and Furniture Anchoring
Customers must follow all supplied safety, installation and anchoring instructions.
Where furniture is designed or required to be anchored to a wall or other structure, customers should ensure that appropriate anchoring is completed correctly.
The appropriate fixing method may depend on the construction of the wall, floor or other supporting structure.
Where the customer installs the furniture, the customer is responsible for using suitable fixing methods and following supplied instructions.
Certain categories of furniture are subject to Australia's mandatory Consumer Goods (Toppling Furniture) Information Standard 2024, including certain clothing-storage units, bookcases, entertainment units, hall tables, display cabinets, buffets and sideboards. Customers should never allow children to climb on furniture and should properly anchor applicable furniture.
21. Product Safety
Bolt Action Furniture aims to ensure that products supplied are safe and suitable for their intended use.
Where mandatory product-safety standards or information standards apply to a product, Bolt Action Furniture will comply with the applicable requirements.
Customers must follow all supplied safety instructions, warnings and installation information.
Nothing in these Terms & Conditions excludes or limits statutory product-safety obligations.
22. Defects and Consumer Guarantees
All products supplied to consumers are subject to the applicable consumer guarantees under the Australian Consumer Law.
A product may be entitled to a remedy where, for example, it:
Is not of acceptable quality;
Is unsafe;
Is not durable for a reasonable period having regard to the circumstances;
Does not match its description;
Does not match an agreed sample or demonstration model;
Is not fit for a purpose made known to Bolt Action Furniture; or
Otherwise fails to comply with an applicable consumer guarantee.
The available remedy depends on the nature of the problem.
For a major failure, the customer may have the right to choose an available remedy such as a refund or replacement.
For a minor failure, Bolt Action Furniture may generally choose an appropriate remedy, such as repair or replacement, within a reasonable time.
Consumer guarantees apply automatically and cannot be removed by these Terms & Conditions. AACCC+1
23. Voluntary 12-Month Warranty
Bolt Action Furniture provides a separate 12-month voluntary warranty against manufacturing defects and workmanship.
The warranty covers eligible defects in furniture and integrated components supplied by Bolt Action Furniture, subject to the terms of the warranty.
The voluntary warranty is additional to the customer's rights under the ACL.
The expiry of the voluntary warranty does not necessarily mean that all consumer rights have expired.

24. Customer Damage and Misuse
The voluntary warranty does not generally cover damage caused solely by:
Misuse;
Neglect;
Accidental damage;
Incorrect installation;
Excessive loading;
Unauthorised modifications;
Unauthorised electrical work;
Failure to follow reasonable care instructions;
Physical damage after delivery;
Improper transportation after customer collection or delivery;
Use outside the intended purpose; or
Other customer-caused damage.
This does not limit any rights available under the ACL.
25. Inspection and Approval
Bolt Action Furniture may inspect furniture where reasonably necessary to determine the cause of an alleged defect or problem.
Customers should not dispose of, modify, dismantle or substantially alter furniture that is the subject of a claim without first contacting Bolt Action Furniture, where reasonably practicable.
Where an inspection confirms a manufacturing defect or other issue for which Bolt Action Furniture is responsible, the appropriate remedy will be provided in accordance with the ACL and any applicable voluntary warranty.
26. Photography and Finished Products
Because furniture is individually made, finished products may contain natural and minor visual variations that do not affect functionality or compliance with agreed specifications.
Where photographs, renders or samples are used for reference, they are intended to communicate the general design, material and finish.
Where a specific feature or specification has been expressly agreed as part of the order, the finished product will be assessed against that agreed specification.
27. Intellectual Property and Designs
Unless otherwise agreed in writing, designs, drawings, plans, renders, photographs, product concepts and other materials created by Bolt Action Furniture remain the property of Bolt Action Furniture.
Customers may not reproduce, manufacture, sell or commercially exploit Bolt Action Furniture's designs without written permission.
Where a customer provides their own design, drawing or intellectual property, the customer is responsible for ensuring they have the right to provide that material for manufacture.
This section does not affect ownership rights that cannot legally be excluded.
28. Customer-Supplied Materials or Components
Where a customer requests Bolt Action Furniture to incorporate customer-supplied materials or components, we may accept or reject those materials at our discretion based on suitability, safety, compatibility and availability.
Where we agree to use customer-supplied materials or components, the customer is responsible for ensuring that they are suitable and legally permitted for the intended use.
Bolt Action Furniture may refuse to incorporate a component where we reasonably believe it may create a safety, compatibility, quality or compliance issue.
Nothing in this section limits our responsibilities for workmanship or services that we provide.
29. Delivery and Risk
Bolt Action Furniture will take reasonable care of furniture while it remains under our control.
Where delivery is arranged by Bolt Action Furniture, responsibility for delivery will be managed in accordance with the applicable agreement and Australian Consumer Law.
Where the customer independently arranges a third-party carrier or collects the furniture themselves, responsibility for risks associated with that transportation may differ.
Nothing in this section excludes any consumer guarantee or statutory right.
30. Unforeseen Circumstances
Bolt Action Furniture will not be responsible for delays caused by circumstances reasonably outside our control, which may include:
Natural disasters;
Severe weather;
Supplier failures;
Material shortages;
Transport disruptions;
Significant equipment failure;
Government restrictions;
Power outages;
Unexpected events affecting production; or
Other circumstances that could not reasonably have been prevented.
Where such circumstances occur, we will communicate with the customer and make reasonable efforts to complete the order as soon as practicable.
This section does not remove any rights the customer may have under the ACL.
31. Privacy
Personal information supplied by customers will be handled in accordance with Bolt Action Furniture's applicable privacy practices and Australian privacy laws.
Customer information may be used for purposes including:
Processing orders;
Communicating about orders;
Arranging delivery;
Arranging installation;
Processing payments;
Managing warranty or consumer claims; and
Providing customer service.
32. Disputes and Complaints
If a customer has a concern regarding an order, product or service, we encourage the customer to contact Bolt Action Furniture first so that we can attempt to resolve the matter promptly.
Customers should provide relevant details, including the order number and description of the issue.
Nothing in this section prevents a customer from exercising any rights available under Australian law or contacting the relevant consumer protection authority.
33. Changes to These Terms
Bolt Action Furniture may update these Terms & Conditions from time to time.
The version applicable to an order will generally be the version agreed at the time the order was placed, unless otherwise required by law or agreed with the customer.
Changes to these Terms & Conditions will not retrospectively remove rights that have already accrued.
34. Severability
If any provision of these Terms & Conditions is found to be invalid, unenforceable or unlawful, that provision will be interpreted or modified to the minimum extent necessary to make it lawful where permitted.
The remaining provisions will continue to operate to the extent permitted by law.
35. Australian Consumer Law
Nothing in these Terms & Conditions is intended to exclude, restrict or modify:
Consumer guarantees;
Statutory warranties;
Product-safety obligations;
Consumer rights;
Remedies; or
Other rights
that cannot legally be excluded, restricted or modified.
If any provision of these Terms & Conditions conflicts with a mandatory requirement of Australian law, the mandatory legal requirement will prevail.

For custom-made orders, the customer may be asked to confirm:
I confirm that I have reviewed and approved the final specifications for my order, including applicable dimensions, materials, finishes, hardware and custom features.
